Cooper, Democrats pressuring Gov. McCrory to concede

North Carolina's incumbent for the governor's seat has dug his heels in and is not going out without a fight; two weeks after the election, Pat McCrory (R) officially asked for a recount on Tuesday.

This recount was filed to meet the original date specified by the state statute, the campaign said.

The vote is close enough that McCrory could request and receive an automatic recount; that cannot happen until all the counties have certified their votes.

"Since losing on Election Day, Gov. McCrory has sought to undermine the results of this election".

Citizens who cast ballots during early voting and then died before Election Day are being inaccurately described as fraudulent voters.

The lawsuit says North Carolina law requires election officials to check the residency of same-day registrants by sending them mail and seeing if it comes back returned.

State guidelines indicate the mailing process should be allowed 30 days.

Reynolds, Nix, and many other Democrats have declared Cooper the victor and have called on McCrory to concede, though final election results remain unknown.

If his cries of fraud end up forcing a vote on the Republican-controlled state legislature, it could rule that McCrory received the most "legitimate votes", ultimately winning him the election.

Supporters of Cooper gathered outside the meeting before it started.

"Why is Roy Cooper so insistent on circumventing the electoral process and counting the votes of dead people and felons?" wrote Ricky Diaz, Governor McCrory's campaign spokesman. "And that's what we're seeing here", said Logan Smith of Progress NC.

Richard Hasen, an expert in election law at the University of California-Irvine, says both McCrory's challenges and the state Legislature's possible court-packing shouldn't be dismissed as mere speculation.

"I think it's great that they're trying to deal with this in a fair and straightforward way, but I doubt it will have much of an impact on the outcome", Bitzer said.

In county races, such as for the board of commissioners or school board, a candidate can request a recount when the margin is 1 percent or less. But Rick Hasen, a law and political science professor at the University of California, Irvine, pointed out on his Election Law Blog that nothing in the North Carolina law could or would prevent the federal courts from stepping in.

Bob Hall of the nonprofit Democracy North Carolina disputes the Civitas claims about the same-day registration process.

Republican Lt. Gov. Dan Forrest said MrCrory is just delaying the inevitable by refusing to concede his loss to Cooper.

McCrory's campaign made the announcement Tuesday in a news release, reports CBS Raleigh affiliate WNCN reports. McCrory's largest challenge, affecting 94,000 votes in Durham County, was thrown out by the county's election board.
