The court approved the settlement agreement between the Russian Federal Antimonopoly Service (FAS) and Google in the Android case.

The deputy head of the Federal Antimonopoly Service (FAS), Alexei Dotsenko, announced the news today, confirming the deal.

In August 2016, FAS imposed a 438 million rouble ($7.8 million) fine on Google which the company still has to pay after reaching the settlement, FAS said.

Google Inc. has agreed to no longer restrict the preinstallation of applications on smartphones running its Android operating system sold in Russian Federation to settle allegations that it abused its dominance in the marketplace, the country's antitrust regulator said Monday.

Google also made a commitment to secure the rights of third-parties by allowing the inclusion of their search engines in the choice window.

In a ruling dated April 3, but only made public on Monday, the Court of Appeals denied Pemberton's appeal due to "lack of merit". The appellate court, however, revised the civil indemnity and moral damages set by the RTC at P50,000 to P75,000 each.

Per the terms of the agreement, Google will no longer demand exclusivity of its applications on Android devices in Russian Federation, and it will not restrict the pre-installation of any competing search engines and applications - including on the Android home screen, FAS states.

It brings to an end a long-running battle between the United States firm and Russia's competition regulator, the Federal Antimonopoly Service (FAS).

The suit followed a complaint from Yandex, a major Russian search company, which is one of the biggest winners of this settlement. In time, FAS imposed additional fines against Google, amounting to almost 1 million rubles in total. Google had been appealing the decision prior to the recent settlement.

That means Google won't be able to pre-install apps on phones, control the default search engine or place its own apps on device home screens in the region. "Now millions of Russian Android users will be offered a choice of search engines on their mobile devices".

"We managed to find a balance between the necessity to develop the Android ecosystem and interests of third-party developers for promoting their mobile applications and services on Android-based devices".
