He was arrested in 2009 and twice in 2011 for driving with a suspended license and was charged with a DUI in 2009.

Banda-Acosta now faces at least seven years in prison and after that he will likely be deported again.

Customs and Immigration officials confirm he's been sent back to Mexico at least 15 times since 2002.

He told NBC 7, he works with some clients who have been deported half a dozen times and some manage to come back to the US illegally, in less than a week.

The boy's parents suffered minor injuries.

Lennox Lake's parents didn't go to court for the arraignment, preferring to stay at their son's side at Rady Children's Hospital.

Lennox remains hospitalized but he is improving and doctors are hopeful he can make a full recovery.

After Border Patrol agents found the damaged vehicle, San Diego police arrested Banda-Acosta who was in the US illegally again, despite his 15 prior deportations.
