Lawsuit makes new rape allegation against Weinstein

The new case follows a similar action which has stalled thanks to the bankruptcy of TWC

Harvey Weinstein was facing a new rape allegation on Friday, including claims that a woman captured video of Weinstein assaulting her, as part of a lawsuit alleging that he had help covering up his misconduct with women.

A brand new Racketeer Influenced Corrupt Organizations (RICO) lawsuit filed Friday in a Manhattan federal court docket accuses Harvey Weinstein's protection lawyer of deceiving a CT lady who accused Weinstein of rape.

Harvey Weinstein faces another rape allegation, days after he was indicted on two charges of rape and a charge of a criminal sexual act.

At that point, it alleges, "Weinstein grabbed her, using brute force to push her flat on her stomach as he pulled up her dress" as she fought.

Thompson said she went to a follow-up meeting with Weinstein at the Tribeca Grand Hotel later in the day in the hopes of closing the video deal, but that once in his hotel room he forced himself upon her.

In a statement to Fox News, Brafman said, "This firm has never represented Melissa Thompson and I personally never met with her or any of the other women named in the lawsuit".

The lawsuit names Harvey Weinstein, Robert Weinstein, attorney Ben Brafman, The Walt Disney Company, Miramax and others, including Weinstein Company board members. As she explained the company's services, she alleges that Weinstein began to caress her legs.

Weinstein has been accused by more than a dozen women of sexual misconduct.

The lawsuit states that Dulany and Weinstein allegedly ran into each other again two months later at the Cannes Film Festival, where they attended a few events together. "I left the Brafman firm well before Brafman ever represented Weinstein, and, in fact, I represent one of the key victims, but Ms. Thompson has never been a client". It alleges racketeering, witness tampering, mail and wire fraud, assault, civil battery, negligent supervision and retention and intentional infliction of emotional distress.

"Thompson was led to believe that Brafman and Spiro were representing victims against Weinstein", the law firm representing her, Hagens Berman, said in a statement.

"I never have and I never would represent Harvey Weinstein".

Brafman is defending Weinstein following his indictment last week on rape and sex crime charges. Brafman is an attorney for Weinstein. "We will soon formally move to dismiss the indictment and if this case actually proceeds to trial, we expect Mr Weinstein to be acquitted".
